The Greens – Encouragement to commit an offence in England and Wales is an offence in itself. It used to be the common law offence of “incitement.” Is there a similar offence in Scotland? It seems so.
A quick net search reveals there is a criminal incohate offence of “incitement” in Scotland A person will be guilty of incitement if it can be shown that he influenced the mind of another person to commit a crime. It is irrelevant whether or not the crime is actually carried out .
But please do not rely on this as I don’t know how reliable it is. The Christian Institute, though in England may be able to provide some cursory advice.
